Article 1: Preamble

These general terms and conditions of sale apply between SARL Darna, 9 avenue Industrielle, 59520 Marquette-lez-Lille, France, and any person visiting or making a purchase via the website www.darnashop.fr.

SARL Darna reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions in force on the date of the order shall apply.

Placing any order for a product listed in the online store on the websites www.darnashop.fr and www.darnashop.be implies prior consultation and acceptance of these general terms and conditions. Contractual information is presented in French.


Article 2: Products

SARL Darna provides a detailed description of all available products on its website, enabling the buyer to know, prior to placing a final order, the essential characteristics of the products they wish to purchase.

The buyer may at any time send an email to SARL Darna if further clarification is required. Photos and illustrations are provided for guidance only and are not contractually binding.


Article 3: Prices

All prices are expressed and processed in Euros and include the French VAT applicable on the day of the transaction. Shipping costs are fixed for Metropolitan France, Belgium, Spain, and Luxembourg.

For other destinations, shipping costs are calculated according to the weight of the parcel and the country of destination. SARL Darna reserves the right to modify its prices at any time without prior notice. The applicable sale price is the one displayed online at the time the order is registered on the website.


Article 4: Availability

Product offers and prices are valid as long as they are visible on the website and while stocks last. Upon receipt of your order, we verify the availability of the ordered product(s).

In the event of unavailability, within 30 days from order validation we undertake either to deliver the ordered product, propose a similar product at a similar price, or issue a refund. Delivery times are given for information purposes only, and we will endeavor to respect them as closely as possible.


Article 5: Payment Terms

Orders are payable by bank card (Carte Bleue / e-Carte Bleue / Visa / Mastercard / American Express).

No banking information concerning you passes through the SARL Darna website. Payment by bank card is therefore fully secure. Your order will be recorded and validated upon acceptance of payment by the banking institution.

SARL Darna reserves the right to refuse delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is ongoing.


Article 6: Delivery

Delivery is made to the address specified by the customer when placing the order. It will be carried out by the carrier of their choice.

Delivery can only occur once the order has been validated by the customer and full payment has been received. In the event of payment refusal, the order will automatically be canceled.

SARL Darna reserves the right to refuse any order from a customer with whom a dispute exists or has previously existed. Delivery costs are borne by the buyer unless stated otherwise in a promotion or special offer and are displayed in the shopping cart.

If the ordered item is in stock, dispatch time is approximately 2 business days for orders placed before 12:00 p.m., and 3 business days for orders placed after this time. Delivery times begin from the date of effective payment.

In cases of force majeure or exceptional events (natural disasters, epidemics, strikes, etc.) delaying or preventing delivery, SARL Darna shall not be held liable.

Delivery times mentioned on the website are indicative only. If the carrier requires additional time, no compensation may be claimed. The customer may request cancellation if delivery exceeds the initially indicated timeframe.

Delivery may only occur if the customer is up to date with their obligations toward SARL Darna. By signing the delivery slip, the customer accepts the products as delivered and no claims regarding transport damage will be accepted thereafter.

It is the customer’s responsibility to check the goods upon arrival and make any necessary reservations with the carrier. If the original packaging is damaged, torn, opened, or shows different adhesive tape than the company’s security seal, the customer must check the condition of the items.

If the items are damaged, the parcel must be refused and a reservation noted on the delivery slip (parcel refused due to being opened or damaged). Upon receipt, the customer must immediately verify the condition and conformity of the goods.

All complaints regarding defects, incorrect quantities, or incorrect references must be made in writing by registered letter with acknowledgment of receipt within 24 hours of receipt. Failing this, the right to claim shall lapse. Any return of goods requires prior agreement from SARL Darna.

If a customer fails to collect their parcel within the carrier’s holding period, SARL Darna reserves the right to charge a flat-rate return fee of €15 including VAT. The holding period is 7 calendar days for collection points and 3 calendar days for Pick-up lockers. The customer must ensure they collect their parcel within the allotted time. If re-shipment is requested, SARL Darna will waive the return fee, but re-shipping costs remain payable by the customer. The customer has 3 months to state their intentions, after which the parcel becomes the property of SARL Darna without refund or compensation.

If a customer exercises their right of withdrawal after the order has been handed to the carrier, they must collect the parcel and return it at their own expense to:

If the customer refuses the parcel and uses Darnashop’s return service, a flat fee of €15 will be deducted from the refund.

If delivery is impossible due to incorrect or incomplete address details provided by the customer, SARL Darna reserves the right to charge a €15 restocking fee (or €30 for international deliveries). The customer has 3 months to claim the parcel, after which it becomes the property of SARL Darna without refund.

For delivery to a collection point, if the selected location is unavailable, the customer expressly accepts delivery to the nearest available collection point. Darnashop cannot choose the replacement location and cannot be held responsible for its hours or location. By choosing this economical delivery method, the customer acknowledges and accepts these terms.


Article 7: Right of Withdrawal

From the date of delivery, private individuals have 15 days to exercise their right of withdrawal and obtain a refund, excluding shipping and return costs, which remain at their expense.

Incomplete, used, worn, damaged products or products not returned in their original intact packaging will not be accepted.

Returns under the right of withdrawal must be sent to:

If returned elsewhere, a €15 processing fee may be charged.

For products sold as part of a bundle (“pack”), only the COMPLETE pack may be returned. Incomplete pack returns will not be accepted.


Article 8: Warranty

In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, these provisions do not deprive the consumer of the legal warranty against hidden defects.

Consumers are informed that SARL Darna is not the manufacturer of the products within the meaning of Law No. 98-389 of May 19, 1998 on liability for defective products.

In case of damage caused by a defective product, only the producer’s liability may be sought.


Article 9: Referral Program

SARL Darna offers a referral program allowing customers to recommend the website to relatives. In exchange for referrals, sponsors receive rewards convertible into discount vouchers.

SARL Darna reserves the right to modify or suspend the referral program at any time, including modifying reward amounts, conditions of use, and validity periods.

The referral program is strictly limited to private use (family, close friends) and excludes influencer activity. Referral codes must not be shared on social media communities or promotional code websites. SARL Darna reserves the right to cancel any reward, voucher, or loyalty discount obtained in violation of these rules.


Article 10: Return Procedure

All return requests under the right of withdrawal must be made through the customer account using the “withdrawal form” to establish a clear date.

Return requests for non-conformity, warranty, or after-sales service must be made in writing to Customer Service by email or post.

Without prior agreement, returned goods will remain at the customer’s disposal at their own cost and risk. All transport, storage, and handling costs are borne by the customer.


Article 11: Data Protection

All information transmitted to SARL Darna remains strictly confidential and will never be sold or communicated to third parties (without customer consent), except those directly involved in order fulfillment.

In accordance with the French Data Protection Act of January 6, 1978 and CNIL recommendations, users have the right to access, modify, or delete their personal data.

Article 12: Liability

Products comply with current French legislation. The buyer is responsible for checking the legislation of the country where products are delivered.

SARL Darna cannot be held liable for material, immaterial, or bodily damage resulting from malfunction or misuse of products.

SARL Darna shall not be liable for non-performance due to force majeure, strikes, postal disruptions, transport issues, floods, or fire.

For products purchased for professional purposes, SARL Darna shall not be liable for indirect damages such as loss of business, profit, or related expenses.


Article 13: Retention of Title

SARL Darna retains full ownership of the goods sold until full payment of the price has been received.


Article 14: Jurisdiction

These terms and conditions are governed by French law. In case of dispute, the parties may seek an amicable solution before legal action.

Failing amicable resolution, the Commercial Court of Lille shall have exclusive jurisdiction, regardless of the place of delivery or payment method.
